Terms of Use (Simfio Games)

These Terms of Use (“Terms”) govern your access to and use of mobile games and applications published by Simfio Games (“we”, “us”, “our”) (the “Apps”).

By downloading, accessing, or using any of our Apps, you agree to these Terms. If you do not agree, do not use the Apps.

2) License to use the Apps

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps for your personal, non-commercial entertainment purposes, subject to these Terms and applicable laws.

You may not:

• copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Apps (except where permitted by law);

• distribute, sell, rent, lease, or sublicense the Apps;

• use the Apps for unlawful, harmful, or abusive purposes;

• interfere with or disrupt the Apps or related services.

3) Eligibility

You must be at least 13 years old to use our Apps. If you are between 13 and the age of legal majority in your country, you represent that you have obtained consent from your parent or legal guardian. If you are under 13, you are not permitted to use the Apps.

4) Updates and changes

We may update, change, or discontinue any App or features at any time, including content, gameplay balance, availability, or requirements. We do not guarantee that any specific feature will always remain available.

5) Ads

Some of our Apps are ad-supported. Ads may be provided by third-party advertising partners. We do not control the content of third-party ads and are not responsible for third-party products or services advertised.

6) In-app purchases

Some Apps offer optional in-app purchases (“IAP”). All purchases are processed by Google Play and are subject to Google Play’s terms and policies.

Prices and availability may change. Purchases are generally non-refundable except where required by law or permitted by Google Play policies.

If you have an issue with a purchase (e.g., an item not delivered), contact us at simfonygames@gmail.com and include your order/receipt details so we can help investigate.

Any virtual currency or items purchased in the Apps are licensed to you, have no monetary value, and cannot be exchanged for real money or goods. We reserve the right to manage, modify, or remove virtual items at any time, without liability to you, except where required by law.

7) User content and communications

If you contact us (support emails, feedback, bug reports), you agree not to submit unlawful, harmful, or abusive content.

You grant us permission to use your feedback to improve our Apps without compensation to you.

8) Intellectual property

The Apps, including all content, graphics, music, sound, story elements, characters, code, and trademarks are owned by Simfio Games or its licensors and are protected by applicable intellectual property laws.

You may not use our intellectual property without our prior written permission, except as allowed by law.

9) Third-party services and links

Our Apps may rely on third-party services (e.g., advertising, analytics) and may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Use of third-party services may be subject to their own terms and policies.

10) Disclaimer of warranties

The Apps are provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, we disclaim all warranties of any kind, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Apps will be uninterrupted, error-free, or completely secure.

11) Limitation of liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

To the maximum extent permitted by law, Simfio Games will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the Apps.

If liability cannot be excluded, our total liability will be limited to the amount you paid to us (if any) for the App or in-app purchases in the 12 months before the event giving rise to the claim.

12) Termination

We may suspend or terminate your access to the Apps if you violate these Terms or if required by law. You may stop using the Apps at any time by uninstalling them.

13) Governing law

These Terms are governed by the laws of Ukraine. If you are a consumer in another country, you may have additional rights under mandatory consumer protection laws in your country, which remain unaffected.

14) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

15) Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date above. Continued use of the Apps after changes means you accept the updated Terms.
